Terms & Conditions

Each tenant agrees to the periodic lease of the selected property, which will be governed in accordance with the following clauses upon acceptance of these terms and completion of payment. Each Tenant is obligated to provide the required documentation for the formalization of their stay.

Homerun Rentals S.L. acts as the booking and contracting party.

Property management, guest services, and operational handling of reservations are carried out by RNTLS Marbella on behalf of Homerun Rentals S.L.

1. Purpose

The Tenant waives the rights to extend their stay beyond the confirmed duration and waives rights established in Articles 31, 32, and 33 of the Urban Lease Act, including rights of extension, subrogation, transfer, right of first refusal, redemption, and challenge of transfer.

The Tenant acknowledges that this is a temporary rental (holiday/occupational use) under Article 3.2 of Law 29/1994 on Urban Leases. Under no circumstances shall this lease be considered a habitual residence.

2. Deposit

Prior to arrival, the Tenant shall provide a security deposit in accordance with Article 36 of the Urban Lease Act, proportional to the duration of the stay.

Homerun Rentals S.L. (via RNTLS Marbella as property manager) reserves the right to:

  • Place an authorization hold on the Tenant’s payment method, or
  • Request direct payment of the deposit

The deposit will be released 14 days after checkout (or earlier if possible), subject to:

  • No damage
  • No missing items
  • Compliance with all rules

Processing times may vary depending on the Tenant’s bank (3–12 business days).

If the deposit authorization fails, the Tenant will have 12 hours to provide an alternative payment method. Otherwise, the reservation may be cancelled.

3. Payment

The Tenant can book the property by completing the booking process, which includes:

  • Providing required documentation
  • Accepting these Terms
  • Providing payment details

Homerun Rentals S.L., with operational handling by RNTLS Marbella, reserves the right to charge the provided payment method as per the invoice.

Payment structure:

  • 50% reservation fee to secure the booking
  • Remaining balance due 31 days before arrival

If the stay is extended and confirmed, the additional amount will be charged accordingly.

If the property becomes unavailable:

  • A similar alternative will be offered, or
  • A full refund will be issued

4. Cancellation 

  • 50% refund up to 31 days before check-in
  • Cleaning fees are always refundable before check-in

In case of complaints:

  • Written notice must be submitted within 24 hours of check-in


Homerun Rentals S.L, with operational handling by RNTLS Marbella, will mediate disputes and retains final decision authority.

A reservation is only considered cancelled once confirmation has been issued.

5. Reservation terms

  • Check-in: from 17:00
  • Check-out: by 10:00

The reservation automatically terminates at check-out time without further notice.

Failure to vacate the property on time may result in:

  • A penalty of up to three times the daily rental rate
  • Additional legal costs if applicable

If the Tenant fails to occupy the property within 4 hours of the scheduled arrival day, the reservation may be cancelled without refund unless prior notice is given.

The Tenant must leave the property:

  • In its original condition
  • Free of personal belongings
  • With all items intact

Extensions are only valid with:

  • Full payment
  • Written agreement

6. Obligations of the parties

These rules apply to the Tenant and all accompanying guests:

  1. Maintain the property in good condition
  2. No smoking inside the property
  3. No excessive noise after 22:00
  4. Return the property in the same condition
  5. No illegal, harmful, or disruptive activities
  6. No structural changes or modifications
  7. Respect maximum occupancy limits
  8. No parties or events allowed
  9. Respect community rules
  10. The Tenant is fully responsible for:
  • Any damages caused
  • Injuries occurring during the stay
  • Loss or deterioration of property

The Owner and Homerun Rentals S.L. shall not be held liable for damages caused by the Tenant or their guests.
